LEGAL NOTICE

1. SELLER AND WEBSITE OWNER DETAILS

In accordance with Article 10 of Spanish Law 34/2002 of 11 July on Information Society
Services and Electronic Commerce (LSSI-CE), the following identifying details of the owner of

The owner is a sole trader carrying on business in their own name and is therefore not
registered with the Spanish Commercial Registry.

2. PURPOSE AND SCOPE

2.1. This Legal Notice governs access to, browsing of and use of the website
https://balddive.com (the "Website"), owned and operated by Alejandro Rodríguez Underyte (the
"Owner").

2.2. Accessing the Website confers the status of User and implies full and unreserved
acceptance of each and every provision of this Legal Notice in the version published at the
time of access. Users who do not agree with its content should refrain from using the Website.

2.3. The Website directs its commercial offering exclusively to consumers residing in the
United States of America, the United Kingdom, Canada and Australia. The Owner does not accept
orders for delivery to other territories.

2.4. This Legal Notice is supplemented by the Privacy Policy, the Terms of Service, the
Shipping Policy and the Return and Refund Policy published on the Website, which specifically
govern the purchase of goods.

3. CONDITIONS OF ACCESS AND USE

3.1. Access to the Website is free of charge, save for the cost of the telecommunications
connection provided by the User's own internet access provider.

3.2. The User undertakes to use the Website and its content in accordance with the law, good
faith, public policy and this Legal Notice, and in particular not to:

a) Use the Website for unlawful purposes, or in any manner which may damage, disable,
   overburden or impair it, or prevent its normal use.
b) Introduce or distribute computer viruses or any other physical or logical systems capable
   of causing damage to the systems of the Owner or of third parties.
c) Attempt to access, use or manipulate data belonging to the Owner, its suppliers or other
   Users.
d) Reproduce, copy, distribute, communicate to the public, transform or modify the content of
   the Website without the express written authorisation of the Owner.
e) Remove, conceal or manipulate notices regarding intellectual or industrial property rights
   or other identifying details of the Owner.
f) Use the content of the Website for third-party commercial or advertising purposes.
g) Place orders using false or incomplete details, or details belonging to third parties
   without their consent, or use payment methods of which the User is not the authorised
   holder.

3.3. The User confirms that they are of legal age in their country of residence and have
sufficient legal capacity to enter into binding obligations. The Website is not directed at
minors and the Owner does not knowingly collect personal data from minors.

3.4. Breach of this clause entitles the Owner to deny or withdraw access to the Website without
prior notice and without giving rise to any right to compensation.

4. INTELLECTUAL AND INDUSTRIAL PROPERTY

4.1. All content on the Website, including without limitation text, photographs, graphics,
images, icons, technology, software, graphic design and source code, together with the trading
name "Bald Dive" and the distinctive signs accompanying it, belongs to the Owner or to third
parties who have authorised its use. No right of exploitation over such content is transferred
to the User.

4.2. Intellectual property rights in the Website and its content are protected by Spanish Royal
Legislative Decree 1/1996 of 12 April approving the Consolidated Text of the Intellectual
Property Act, and by the international treaties to which Spain is a party.

4.3. Certain product images and descriptions may originate from manufacturers or suppliers, who
retain their respective intellectual and industrial property rights. Their reproduction by third
parties is likewise prohibited.

4.4. The User may view the content of the Website and may print, copy or store it, provided that
this is exclusively for their personal and private use.

4.5. Any unauthorised use of the content constitutes an infringement of intellectual or
industrial property rights and will give rise to the exercise of such legal action as may be
appropriate.

5. DISCLAIMER OF WARRANTIES AND LIABILITY REGARDING THE WEBSITE

5.1. The Owner does not warrant the uninterrupted availability or continuity of the Website, and
may suspend access for reasons of maintenance, security, updating or force majeure.

5.2. Within the limits established by law, the Owner shall not be liable for loss or damage
arising from:

a) The unavailability, discontinuity or malfunction of the Website.
b) The presence of viruses or other harmful elements in the content, provided that the Owner has
   adopted reasonable security measures.
c) Unlawful, negligent or improper use of the Website by Users.
d) Typographical errors or omissions in the content, without prejudice to the Owner's obligation
   to honour the prices and conditions displayed in accordance with applicable consumer
   legislation.

5.3. Nothing in this clause limits or excludes the liabilities owed by the Owner in its capacity
as seller to the consumer, which are governed by the Terms of Service and by the specific
policies published on the Website.

5.4. Nothing in this Legal Notice excludes or limits the Owner's liability for death or personal
injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other
liability which cannot lawfully be excluded or limited.

6. LINKS TO THIRD-PARTY WEBSITES

6.1. The Website may contain links to third-party websites. The Owner exercises no control over
such websites or their content and accepts no liability in respect of them.

6.2. The existence of a link does not imply any relationship, association, recommendation or
supervision by the Owner in respect of the linked website.

6.3. The Owner will immediately remove any link of which it has actual knowledge that it leads
to unlawful content or content which infringes the rights of third parties, in accordance with
Article 17 of Spanish Law 34/2002.

7. ACCURACY OF COMMERCIAL INFORMATION

7.1. The Owner takes reasonable care to ensure that the information published on the Website,
including product descriptions, prices, availability and delivery times, is accurate and not
misleading.

7.2. Any customer reviews displayed on the Website are genuine and are published without
modification of their substance. The Owner does not commission, incentivise without disclosure,
or suppress reviews.

7.3. The total price displayed at checkout includes all mandatory charges payable by the User.
No mandatory fee is added at a later stage of the purchase process.

8. PERSONAL DATA PROTECTION

The processing of Users' personal data is governed by the Privacy Policy published on the
Website, prepared in accordance with Regulation (EU) 2016/679 (GDPR), Spanish Organic Law 3/2018
of 5 December (LOPDGDD) and, in respect of Users residing in the United Kingdom, the UK General
Data Protection Regulation and the Data Protection Act 2018.

9. COMMERCIAL COMMUNICATIONS

The Owner does not send commercial communications by electronic means which have not been
previously requested or expressly authorised by their recipients, or which do not relate to goods
similar to those previously purchased, in accordance with Articles 20 and 21 of Spanish Law
34/2002. The User may withdraw consent at any time using the link provided in each communication
or by writing to bald.dive2@use.startmail.com.

10. AMENDMENTS

10.1. The Owner reserves the right to make such changes to the Website as it considers
appropriate without prior notice, and may change, remove or add content and services, as well as
the manner in which they are presented or located.

10.2. Amendments to this Legal Notice will not have retroactive effect and will not affect orders
already confirmed, which will be governed by the conditions in force at the time they were placed.

11. SEVERABILITY

If any provision of this Legal Notice is held to be void, unenforceable or unfair, that finding
shall not affect the validity of the remaining provisions, which shall continue in full force. The
affected provision shall be replaced by a valid provision reflecting the original intention of the
parties as closely as possible.

12. GOVERNING LAW AND JURISDICTION

12.1. This Legal Notice is governed by Spanish law.

12.2. Any dispute arising from access to or use of the Website shall be subject to the courts of
Motril (Granada, Spain), unless mandatory consumer protection legislation of the User's country of
residence provides for a different, non-excludable forum.

12.3. Nothing in this Legal Notice deprives consumers residing in the United Kingdom, Canada,
Australia or the United States of America of the rights granted to them by the mandatory consumer
protection legislation applicable to them, nor of the right to refer a matter to the competent
consumer protection authority or dispute resolution body in their country of residence.
